Melania is an employee, and Stormy was a contractor.
The real question here is "What's the difference between Stormy and the hundreds of other contractors Drumpf stiffed?"
Stormy found a way to get at least part of the compensation for the thankless job she did for him, without going to court.
I say this as someone who truly believes that sex work should be decriminalized, regulated, taxed and organized into a union, so the workers can be compensated for what they do, be it on-camera or at being chased around a room by a disgusting client in tighty-whiteys telling you how you are just like his daughter.
Why should benefits like health care, a path to citizenship, housing and childcare benefits be limited to those who marry their johns?
Or Donald Johns, as the case may be.

If they issued a 1099 there would be a record of a payment to Stormy Daniels and some eyebrows could be raised if there was ever an audit. If you are going to pay off porn stars, the less of a paper trail you have, the better.

Stormey sets up a sole proprietorship called tuv consultants. She opens a bank account for tuv but tells the bank that xyz consultants is a d/b/a. She gives Donnie an invoice from xyz consultants.
She cashes the check made out to xyz consultants.
Donnie has a business expense and an invoice to back it up. Stormey has the cash. Theres no paper trail linking them unless the bank volunteered that xyz was a d/b/a for tuv consultants and that stormey was an authorized
person on that account.

(4,448 posts)The IRS doesn't care. It's just happy that the 1099 was issued for the payment. In the event of an audit, this is exactly what -SHOULD- happen.
What would raise eyebrows, would be if a payment was made without a 1099 or vice versa.
It's then up to the individual receiving the payment to account for it on their personal or business return.
