"I told Mexico, and I respect what they did, I said, look, your laws are very powerful, your laws are very strong. We have very bad laws for our border and we are going to be doing some things, I spoke with (Defense Secretary James) Mattis, we're going to do some things militarily. Until we can have a wall and proper security, we're going to be guarding our border with the military. That's a big step," he said during a luncheon with leaders of the Baltic states.
He continued: "We cannot have people flowing into our country illegally, disappearing, and by the way never showing up for court."
Trump has privately floated the idea of funding construction of a border wall with Mexico through the US military budget in conversations with advisers, two sources confirmed to CNN last week. His remarks Tuesday come on the heels of multiple days of hardline immigration rhetoric from the Trump White House, with the President calling on Congress to pass strict border laws in a series of tweets beginning Sunday.

(6,324 posts)There is a lot the military is allowed to do even under PC.
Pretty much everything but actually make an arrest or detention. As long as a Border Patrol agent does that part its legal for the military to do anything else in support. Set up observation points and report in crossings, drive vehicles, aid in searches of vehicles, pilot aircraft, etc.
There can be a squad with 10 Soldiers and 2 Border Control agents and as long as any arrests are made by the Bordrr Control agents its compiant with Posse Comitatus.
The act prohibits federal troops from executing the law. That generally means making arrests or forcing compliance with the law (such as something even as benign as doing traffic control can count). But they can assist LE with that in support roles.
That has been done on the border in varied amounts for decades, so the legality of it is not in question as long as they dont move into actual execution of laws.
For example there could be Soldiers on observation points on the border who radio in that they see crossers. Then other Soldiers can drive trucks that have Border Patrol agents to the location, the Border Patrol makes the apprehension, the Soldiers drive them and the trucks back.
That essentially lets you use Military as a force multiplier that allows Border Patrol to do more with the same manpower.

(2,857 posts)I've been pushing it since Trump started trying to get the wall built. I see it as a way to shut the reps up long enough to get through his term without wasting money on a wall.
My plan was to use the individual states National Guard units as support during their 2 week commitment per year with each state taking turns acting as support. They could do a lot towards making the job of Border Patrol more efficient and the individual states are already going to have to pay the NG for that time so not an extra expense. I sent the idea to my Senator and Representative, but it will probably never happen

(6,324 posts)Before I go into that, it should be noted that Posse Comitatus actually wouldnt apply to National Guard troops there in state paid orders. As long as they are paid and managed by the state they can have full arrest and law enforcement powers as much as the state wishes to give them.
That is true even if the stage uses money provided by the Feds. Case in point all the troops you saw in airports after 9/11z
However Id down with Guard/Reserve personal doing it on 2 week annnual trainings would be inefficient. By the time you account for travel time, setting in, getting trained on the mission etc you scarcely will have time to pull more than a few days of the actual mission before its time to return.
In addition units now are in specific training plans in a 5 year cycle that have certain training events and milestones they have to meet along that cycle, so that would mess all that up.
If you were going to use Reserve/Guard personnel your better plan is to stand up a task force filled entirely with volunteers. Offer 179 day tours, that way it is a temporary duty and they are still assigned to a home unit. Stand up your command and control with a mix of active units assigned there full time for continuity and the 179 day tour volunteers and you have a good plan.
The 179 day your plan also lets them screen volunteers for exactly who is needed for the mission, such as making sure a high percentage of them are Spanish speakers.

You can have 11 Soldiers and one Border Patrol agent and as long as the Border Patrol agent is the ones who makes any arrests they are legal.

The Posse Comitatus Act is a United States federal law (18 U.S.C. § 1385, original at 20 Stat. 152) signed on June 18, 1878 by President Rutherford B. Hayes. The purpose of the act in concert with the Insurrection Act of 1807 is to limit the powers of the federal government in using federal military personnel to enforce domestic policies within the United States. It was passed as an amendment to an army appropriation bill following the end of Reconstruction, and was subsequently updated in 1956 and 1981.
The Act only specifically applies to the United States Army and, as amended in 1956, the United States Air Force. While the Act does not explicitly mention the United States Navy and the United States Marine Corps, the Department of the Navy has prescribed regulations that are generally construed to give the Act force with respect to those services as well. The Act does not apply to the Army National Guard and the Air National Guard under state authority from acting in a law enforcement capacity within its home state or in an adjacent state if invited by that state's governor. The United States Coast Guard, which operates under the Department of Homeland Security, is not covered by the Posse Comitatus Act either, primarily because although the Coast Guard is an armed service, it also has both a maritime law enforcement mission and a federal regulatory agency mission.
The title of the act comes from the legal concept of posse comitatus, the authority under which a county sheriff, or other law officer, conscripts any able-bodied man to assist her or him in keeping the peace.
