One thing to note about Muller telling Trump that he was a subject and not a target.

That happened about a month ago, in early March. Since that time it is possible that he has become a target.

Generally yo do not subpoena a "target" before the grand justly. But you can subpoena a subject. If Mueller wants to keep the subpoena option open....
