Thats one reason I both thinknthe pressure should be applied to Spanky nonstop and fear the same.

(6,810 posts)The judge said that if he was joining the legal team in the specific court case that he will be ordered not to talk publicly. That it was OK for him to talk if he was not part of the prosecution. Avenatti said he doesnt need to be part of that legal team.
The judge told him she was not against his talking per se, but that if he was part of the team he would not be allowed to talk about it. I saw him explain this when he was on Lawrence ODonnells show that night.

(22,037 posts)Judge Kimba Wood is presiding over the Federal case against Cohen in the Southern District of New York. Mr. Avenatti chose to withdraw his request to be admitted to the case without prejudice, which means he can request to be admitted at a later date.
Meanwhile, Stormy Daniels' cicvil case was filed in California and Mr. Avenatti has not been told by that judge to shut up.
There are so many people who think Judge Wood was being critical and punitive.

(5,586 posts)Trump would have been talking to Cohen, and any conversations about any ongoing legal activity will be protected by privilege. There's nothing illegal about what Trump did with Stormy Daniels, and she agreed to take the money. I'd be almost certain that those tapes are included in the 252 items the Special Master has received back from Trump and the Trump Org as privileged.
We know Trump is paranoid. I'd be highly skeptical if Trump would knowingly tolerate a 3rd party being involved in any legal conversations with his 'fixer.'

(115,706 posts)It's actually a pretty narrow privilege; just because you're speaking with a lawyer doesn't mean your conversation is privileged. If Trump's conversations with Cohen had to do with whether Cohen has successfully bullied or strong-armed somebody, or Trump is directing him to bully or strong-arm somebody, that's not seeking legal advice and it would not be protected. And if someone else was in the same room while the phone conversations took place, the communications wouldn't be privileged regardless of their content. Most of what Cohen did for Trump, by Trump's own implicit admission, was not legal work. He was acting as a fixer/bag man, not a lawyer.

(5,586 posts)Thats not illegal. Yelling at someone on the phone is not illegal. Threatening someone with a lawsuit is not illegal.
If he threatened someone with violence, or threatened someones loved ones, thats illegal. And if Trump was on the phone, then hes complicit, but not otherwise.

Avenatti, some 4 pages later in the transcript:
"Mr. Ryan states there are recordings relating to my client. They are under lock and key. He stated that on the record. So that's now been confirmed."
