Judge in Brock Turner case, who sparked outrage after 6 mo. sentence for sex assault, just voted out



The judge involved in the Brock Turner case — who sparked outrage after six-month sentence for sexual assault — was just voted out of office, SF Chronicle reports.





Persky is the first California judge to be recalled in 86 years, after a two-year #RecallPersky campaign to get him out of office.

A lot of money was spent opposing the recall. The slogan was "Get the Facts". The more facts I got, the more I realized this guy needed to go. It wasn't just Brock Turner. Persky had made standard a policy of reducing the inconvenience of punishment in sexual assault and DV cases. This judge was letting guys off because they were from an affluent part of society and didn't want to interfere in their professional success.

To their credit, local boards and state legislatures changed the laws to make sentencing in these cases more harsh. Good did come out of this. Clearing Persky out was the last bit.

Goodbye, Persky. Don't let the door hit your ass on the way out.

For the record I would have, reluctantly, voted for recall not because Persky wasn't following guidelines, he was, but to send a message that they need to re examine the guidelines.

In your reply you seem to not be aware that the recall campaign had a lot more money than the retain campaign;

The recall campaign raised more than 1.2 million and outspent the retain Persky campaign 3:1

You also seem to be unaware that he was, in fact, following the guidelines of the state to reduce mass incarceration. The facts are is that he followed the guidelines of the probation department.



Today, Dauber echoes the progressives and the populists, while against her stands nearly the entire California legal establishment. The Santa Clara County Bar Association, a group of retired judicial officers from Santa Clara County, the California Judges Association, 90 California law professors and more than 400 public defenders and attorneys publicly came out against the recall.

Aaron Persky is a liberal democrat that was appointed by Gray and had an outstanding record and received awards for his work with the poor and on civil rights.

He received a lot of local support from Progressive feminists and his retention campaign was headed by Judge Ladoris Cordell who was the first African American judge in Northern California.

While I would have voted for recall to send a general message on sexual assault I wouldn't have been happy about it Persky was following legislative guidelines for leniency for first time offenders to try and reduce mass incarceration.




When he considered the damage a prison term would do to Turner, Persky had been following California sentencing guidelines, which allow lenience for youthful or elderly defendants with no significant criminal record. The state’s prison overcrowding crisis also generally motivates judges to seek alternative punishments and minimal incarceration for new offenders. “He’s a 19-year-old with no criminal record. It should be very hard to send them to jail,” Goodman said. Many Persky supporters also dispute the premise that Turner was let off lightly, since he will have to register as a sex offender for the rest of his life. “If this were my client, I’d say take prison over sex offender registration,” Goodman told me.



The force behind the recall made "white privilege" one of the key factors of the campaign which I found particularly disturbing because Persky had been awarded by the community for working hard to keep at risk kids from ending up in jail. Also, given the fact that his wife is a person of color and that his children are biracial made that a particularly unfair criticism.

As I said I would have voted for recall but I don't think Persky was the problem but a larger message needed to be sent about not tolerating date rape, which is a much bigger problem than people realize.
