The Trump administration is packing appeals and district courts with young, ideologue nominees. They come from the Federalist Society, which for 40 years has been taking money from billionaires to identify pro-corporate, anti-average American lawyers, raise their profiles, and get them judgeships.

2. Hyperbole

First, you can say what you want. But Trump's presidency is, legally, legitimate. And his nominees for judges etc are legitimate. You can say they're not but it won't change a damn thing.

Second, yes Trump has named a bunch of judges early in his presidency. At the appellate court level he has had 21 nominees confirmed and has another 13 pending. But there are currently no other vacancies for him to fill on the appeals court. And while most of his nominees will be serving for at least 20 years (2038), it's highly unlikely that most will still be on the court in 2050; 11 of the 21 confirmed at this point will be between 85 and 100 in 2050, only 7 will be in their 70s. For comparison's sake, 55 court of appeals spots were filled by Obama.

At the district court level, Trump has filled around 20 spots and has another 70 or so nominees pending out of the 677 authorized judgeships. There are another 50 vacancies. Obama filled 268 district court judgeships.

If, and its a huge if, the Democrats could capture the Senate, they could slow the process of filling vacancies. That's our best bet, not shouting into the void that Trump's appointees are illegitimate.

3. Russia likely stole the Senate. Democrats need good messaging.

The goal of Russian intervention was to suppress the Democratic vote. This is widely accepted. They worked in Wisconsin and Pennsylvania. GOP extremist Pat Toomey won by a small margin. Russ Feingold in Wisconsin lost by a small margin. Several other GOP senators won by small margins in rust belt states.

John Brennan said he believes Russia flipped the election.

Without Russia the GOP would not control the Senate. And there would be a Democratic president.

Democrats are afraid to say that. But it’s a truth they should be repeating.

Because Gorsuch does not deserve his seat and the other judicial appointments do not deserve theirs.

If a wave of popular sentiment rises up, these judges can be impeached.



Re judicial stats: just listen to Ron Klain in the podcast above. Previous presidents had a vetting process, including extremist GWB. This president has handed control to the Fed Society. Meanwhile McConnell has shredded the blue slip rule. And he canceled the August recess so more judges can be approved. This is a smash-and-grab assault on America that we will feel for 50 years.

5. You're dreaming if you think any judge is getting impeached because he or she

was nominated by Trump. Hell, almost all of the District Court judges were confirmed with zero or minimal opposition -- even though most were confirmed this year (after the investigation of Trump had begun).

And exactly when are we going to "take control" to the level where we could impeach and remove a hundred plus members of the judiciary and how do you think the public would react to Congress spending time on that.
