The military base did their job

What I read via a DOD memo
He approached the gate with only a NYCID
He was sent to the pass office
In the course of issuing a pass they ran him thru NCIC
He popped on a warrant for deportation in 2010
Once that happens they were Required to call the issuing authority as he was listed as a fugitive from justice
ICE shows up and the rest is where we are now

If I was standing that watch I would have done the same thing. So I guess I don’t understand why we should be upset with base personnel. Nobody is allowed on base without being properly identified even the pizza guy that is just a fact and it won’t change. Whoever let him on before if identified will get an Article 15 or Court Martial for allowing him.

Reading further into this
He consented to a voluntary order of deportation in 2010 in hopes it would allow him a chance to return legally but found out his girlfriend was pregnant. The court didn’t allow him to revoke his plea deal and he skipped out on it. To take care of his family here. Now the harshest among us would say then they all should have left ,but his girlfriend now wife is an American citizen. Which complicates matters because she can’t just arbitrarily live in another country either.
Hopefully this family will get a good attorney and get a compassionate ruling from the court.

From what i heard, Ft. Hamilton is blackballed from all local deliveries. They got to brownbag their shit or go off base.

Every time I go onto a military base, I have to show ID. Even when I am with military personal. Even if I have already been cleared and have a pass.

Everyone has to show ID to get on base. If you are military, you need to show your driver's license and military ID. Several times I have gone on base with the Commander of the Military Police unit. Even though the gate was manned by his own soldiers, he had to show ID. One time his car was selected to be searched.

There have also been times when I had to show proof of insurance & registration. Much of the checks are random. You can go on base without a problem a few times and then do a random check on your license, insurance, tags and even a vehicle search. Or you can be chosen for a thorough check the 1st time you go through the gate.

You are right. This is their job. They can be discharged or reprimanded if they did not follow protocol.

That being said, what happened was shitty. All of it could have been avoided if someone else delivered the pizza to the base.

4. If I managed a local restaurant I wouldn't send delivery people to the base.

Too much risk to my employees, too much hassle.

I doubt the base will be getting many food deliveries now.

And the military is a good chunk of your business, you as the owner would make sure the drivers you send onto base know what could happen to them if they have a want or warrant on them. You would most likely go broke in your scenario.

But retired military are not all saints. Some maybe wanted for failing to pay child support, spousal support, etc. There ID will most likely be scanned at the gate using a wireless handheld scanner too.

They followed their procedures. They are vulnerable to attacks from terrorist, everyone that is visiting has to be verified. Technology, just now makes it a lot easier for them to do that.

9. Yes, every base I go into now they scan my Military Retired ID

They use a remote hand held scanner that links to NCIC. If I had a hit on me for a warrant, I would be detained and the appropriate law enforcement agency would be called to verify hit.

Even a good attorney is most likely not going to help in this case. He violated the volunteer order he agreed to. Violation results in a 10 year bar. If he would have immediately married his girlfriend (an American Citizen), his wife could have petitioned for him. And if his name was put on the birth certificate as the father at the time of the child's birth, most immigration officers would see that as a valid marriage and approve the case. Of course it would be sent to consular processing and it doesn't happen overnight. Probably would take around a year. Now if his wife was a legal permanent resident at the time, it would take about 2 years or more.

14. Trying to drive onto a military base with no license and an active deportation warrant

On a 1-10 scale of stupid things to do it is about a 35.

It’s literally driving up to law enforcement and saying “here I am violating a bunch of laws”.

15. Many years ago, I delivered pizzas, frequently to a military base.

I hated it because of the hassle at the gate, and also because they were the absolute worst tippers ever. But at the gate, I always had to show my driver’s license, sometimes insurance and registration.

If the guy had no license, he had no business behind the wheel. Period.
