Will he subpoena them all at once? Kushner, Don Jr, Roger Stone, and Donald Trump?
Will they all attempt to argue that they cannot be subpoenaed? Or just one??
Mueller is walking a fine line. He doesn't want to complete the investigation before the mid-term elections and he doesn't want the Republicans to end it involuntarily. Those are the parameters he is working within, in my opinion.
But, at the right time, there may be a subpoena from Mueller? There is little doubt it would be challenged in court or wherever else it could be challenged. Donald Trump has no intention of being interviewed by Robert Mueller. Robert Mueller knows that.
He is stringing this investigation along until after the elections, even though he probably has all the evidence he needs right now? It's a cat and mouse game at the moment and Donald Trump doesn't realize he is the mouse.

(3,344 posts)He should have been publicly asking for these interviews long before now. He's allowed Trump to further consolidate his power and allow the public to begin forgetting about the investigation.

(31,802 posts)Why would Mueller need to subpoena someone he has already talked to?
With regards to Trump a subpoena of the president would take at least a year of litigation. I am sure Mueller does not want to go through that and would like to do a compromise if possible.

(21,916 posts)Robert Mueller's investigation appears to be air-tight and doesn't leak. Accordingly, all we know is what Giuliani or others say is happening. Given their previous history of prevarications, we really don't know what is going on within Mr. Mueller's team.
What we do know is that Mr. Mueller has been months ahead of the stories in the media. When he has brought indictments or served subpoenas, the public records show that he has known facts for quite some time before he acts. I suspect it's because the prosecutors are meticulous. For example, after one witness (I've forgotten his name) was interviewed, he said that the prosecutors knew more about what was going on in Trump's campaign than anyone involved in it. The questions were so specific and detailed that the witness couldn't even remember the chronology of some events.
One minor disagreement, kentuck. I really don't think Mr. Mueller is planning his investigation around the mid-term elections. I think he is following the evidence and taking actions that align with that evidence. Although he is a (probably old-school) Republican, his professionalism suggests that he is acting in an apolitical manner.
A last point: Trump knows he's in trouble. The excellent Charles Blow has a column in today's NY Times that expresses this fear far better than I could. Here's the take-away:
