These children are detained on their own account, for being undocumented. That is why there are 3-year-olds in court. If you commit a regular crime, your child is not a party to the case. Not the same thing at all.

misdemeanor, it's an infraction (at least in the states I've lived in).

And I believe there are misdemeanors for which a person can go to jail (at least a judge could decide to put you in jail for it, whether it often happens I'm not sure).

However, your child is not taken away from your family because you committed a crime and put into jail as well. And you know where they are while you're locked up (presumably). That's the more important point IMHO.
