(8,200 posts)If I had to lay a bet today, I would have to conclude that it will be minimalized in comparison to his accomplishments of deregulation to enable the banks to rip us off, destruction of the environment, demolishment of trade agreements, alienating everyone of or allies, turning the Moslems into arch enemies, destroying the credibility FBI, CIA along with the entire Intelligence system, waging war on immigrant children and jailing every immigrant he can get in the crosshairs, etc., etc. plus, most importantly forming a allegiance to our swore enemy, Russia. After a brief public handwringing that is totally the fault of Hilary and her emails, they will dust off their soapbox and with renewed vigor intensify their attack on Democrats as un-godly, atheistic unamerican liberals intent on the destruction of wholesome real Americans.

(11,830 posts)right after this happened, I read a Tweet from ex-CIA John Brennan (am I anywhere close to being right about that?) and there were SO MANY against Brennan - that he was a Communist, that we don't have any real evidence that Trump colluded with Russia ... and a lot more. So, sadly, this probably will not make a difference.

Those of us that served essentially take the same oath. 'to support and defend the Constitution against all enemies foreign and domestic".
Their inaction says the oath is not worth the paper it was written on it their opinion.
So what would happen to any new recruit who refused to take a "worthless" oath. Would they still let them serve?

Art. III requires two witnesses to convict someone of the crime of treason. Conveniently, the 2-hour Trump-Putin session in Helsinki, which Trump says fully turned around our bad relationship with Russia, was conducted with no witnesses but the principals and their translators.

(9,978 posts)Ive been reading various descriptions of treason, and most seem to say that a key word is enemy.An enemy is defined as someone who has declared war or is openly at war with the U.S. Obviously, Russia has not declared a formal war on the U.S., but does Putins use of active military intelligence agents to conduct their cyber attack represent an open war? Even Ethel and Julius Rosenberg, who committed espionage during WWII, were charged not with treason but with conspiracy to commit espionage, for which they were executed so definitely a serious charge. So is the Trump campaign guilty of conspiring with Russian agents instead of treason? The legal distinctions are quite confusing to this non-lawyer!

(42,700 posts)And its not treason because, as a legal matter, we're not at war with Russia and they're not an "enemy." They are not a friend, but there is, for constitutional purposes, a large gap between being allies and enemies.
Consider the normal attributes of two countries at war: suspended diplomatic relations, suspended trade, suspended travel. We have diplomatic relations with Russia. Hundreds of thousands of Americans will visit Russia as tourists. And we have billions in trade with Russia.
What the Russian military officers did was a crime, as reflected in the Mueller indictment. Americans, including Americans that are or were associated with the Trump campaign and/or administration likely will be named as co-conspirators with the Russians. Maybe Trump will be so named. But that still falls short of treason, just as the crimes for which the Rosenbergs, Aldrich Ames, Robert Hanssen and others were prosecuted did not include treason. And just as the activities of those of us who opposed US involvement in Vietnam were not prosecuted as treason, even when they included activities that, according to some, gave aid and comfort to the North Vietnamese (such as counseling individuals on how to legally -- or illegally -- avoid the draft). Hell, some even claim Daniel Ellsberg committed treason by revealing the Pentagon Papers. That's the risk of giving the treason clause in the Constitution a broad reading -- it can be used in many ways.
