I was surprised a bit, because the statute actually includes reference to enemies in WAR Time.

Did she look up some Supreme Court cases on the issue too? Did she look up "open hostility"? n/t

Since it is not clear that our laws would include CYBER war, I think there is considerable question as to whether a legal case could be made.
Do I think he's a traitor? You are damned right. But, I noted Matthew Miller's discomfort when she said that, so I think she may be "over her skis" on this.
Just compared today to Pearl Harbor or Krustallnacht.
