Clearly both Trump and Cohen camps have it and given Trump et al waived privilege, both CAN and ARE talking about it.

And we don't have a transcript.

Cohen's lawyers discovered it and gave it to Trump's lawyers. We're not sure when that happened.

It's existence was likely leaked by one of those two teams. I suspect the Trump team leaked it.

Cohen made payoff deals for Trump. Trump denies knowledge of these deals but the tape apparently confirms he knew. Not a surprise to any who was following the story and understood how Trump operates. But prosecutors need proof, and there it is.
