Interesting ruling today.
The 9th U.S. Circuit Court of Appeals ruled 2-1 that Hawaiian officials had violated George Young's rights when he was denied a permit to openly carry a loaded gun in public to protect himself.

(42,641 posts)If the legal consensus were to be that open carry is not allowed, it would not be allowed. The (Russian money taking) NRA spends a lot to influence politicians and gun owners.

(1,904 posts)But that decision would not likely survive if SCOTUS takes it up. For that reason, the 9th may just sit on this one, to avoid risking this going to SCOTUS and setting national precedent. If they overturn this En Banc, its pretty much guaranteed to be appealed to SCOTUS, by which point Kavanaugh will already have been seated. If any gun case gets to SCOTUS after Kavanaugh is seated, it will be 5-4 siding with the guns.

11 of the 29 would be used in an en banc review.

I understand that is just my opinion, but if the second amendment is interpreted that everyone has the right to have a gun with them any time and anywhere, I do not see why that needs to be open carry?
