A Letter From One of My Senators - Funny, Not Funny

A "return" letter from one of my senators and my reply back to him.

Dear KingBob,

Thank you for contacting me regarding the nomination of Judge Brett M. Kavanaugh of the U.S. Court of Appeals for the D.C. Circuit to be the next associate justice of the Supreme Court. I am glad to have the benefit of your views.

Associate Justice Anthony Kennedy gave formal notice to the President that he intends to retire from the Supreme Court of the United States on July 31, 2018. As you know, the Senate has the constitutional obligation to provide the President with "advice and consent" on judicial nominations, and I take this responsibility very seriously. I am actively reviewing the qualifications of Judge Kavanaugh and look forward to meeting with him. President Trump has nominated a highly qualified and well-respected legal scholar to fill this position.

The Senate should act swiftly to fill this important vacancy. The confirmation of a Supreme Court justice prior to a midterm election is a common practice. The President has fulfilled his executive responsibility to nominate an individual who will uphold the core values of our Constitution and apply our laws as written.

You state that you have a constitutional obligation to provide “advice and consent.” It seems you and Mitch wildly failed your obligation by not “providing advice and consent” on Merrick Garland just two short years ago. You state that confirmation of a Supreme Court justice prior to a midterm election is a common practice (now three months out), but you didn’t do your constitutional duty when the elections were more than six months out. Was it a deliberate fail or party over country?

Brett Cavanaugh is neither highly qualified nor is he a legal scholar. He has not been rated by the American Bar Association, but rather by the Federalist Society and the Heritage Foundation under the very narrowest of guidelines. As for being a legal scholar, that is risible on its face. Among other things, he has indicated that there should be no precedents (stare decisis) on which to base court decisions and also want the president not to be bothered with investigations into potentially illegal actions because the investigations would “take up too much of the president’s time.” Oh, and, he states that U.S. v. Nixon was wrongly decided ( a unanimous decision, 8-0 with Rhenquist abstaining due to conflict). Risible, full stop. Furthermore, he is politically aligned against socially positive groups and causes and will cause tremendous harm to this republic.
