The Trump administration is considering bypassing Congress to grant a $100 billion tax cut mainly to the wealthy, a legally tenuous maneuver that would cut capital gains taxation and fulfill a long-held ambition of many investors and conservatives, the New York Times reports.
Steven Mnuchin, the Treasury secretary, said in an interview on the sidelines of the Group of 20 summit meeting in Argentina this month that his department was studying whether it could use its regulatory powers to allow Americans to account for inflation in determining capital gains tax liabilities.
Said Mnuchin: If it cant get done through a legislation process, we will look at what tools at Treasury we have to do it on our own and well consider that.

(82,849 posts)Oooh, the Republicans were just so grrrr mad! when Obama signed those executive orders. Sure, Obama had tried to work a legislative proposal through Congress, but when Republicans refused even to discuss those proposals, Obama would turn to an Executive Order to accomplish something. Oh, the Republicans were fit to be tied: Who did Obama think he was, anyway? An emperor or a king? Just issuing laws by fiat like that!
Trump, with the iron-clad advantage afforded him by congressional majorities and pliant judicial officers, can't legislate his way out of a wet paper bag. Now the administration is considering a tax cut for the wealthy by proclamation. What sort of reaction can we expect from congressional leadership to this trespass on their constitutional authority? Crickets or "It's real good that you done that, Donnie. Yup, real good."
