2) He lies to a federal agent, prosecutor, or grand jury -- about something substantial, like breaking the law.
3) He invokes his 5th Am right to not incriminate himself.
Of course he's going to tease about maybe being interviewed, then not, then maybe, then not, because his entire playbook here it delay, delay, delay.
