10. "Duty to warn"

I haven't heard anyone make the case (yet) but I personally think intelligence professionals like Brennan and the others who have considerable national security knowledge and experience could/should be covered--though not legally bound--by the concept of "duty to warn." The public needs reliable sources who have the background to know when it's time to blow the whistle; someone on active duty may be afraid to risk being punished for it.
