"Good Faith" A legal term that might help resolve the Presidential indictment problem.

It's now established that Trump committed a federal crime to influence the election which helped get him elected to the presidency.

The understanding is that as president, he now has protection from an indictment to answer to the crime that he committed.

This is the conundrum of the Constitutional crisis in regards to indictment, as long as Trump is the sitting president. But it seems clear that the good faith benchmark should apply.

Good faith: Honesty; a sincere intention to deal fairly with others.

Good faith is an abstract and comprehensive term that encompasses a sincere belief or motive without any malice or the desire to defraud others. It derives from the translation of the Latin term bona fide, and courts use the two terms interchangeably.

seems you kinda need the trial to determine good faith.

do can you indict or not?
can you have a criminal trial or not?

can you determine if a president is acting in good faith somehow prior to indictment and trial? if so, who makes that determination?
