And you know who gets to decide whether a Supreme Court Justice recuses himself? That Justice! It's an unreviewable, unaccountable decision the Justice and the Justice alone makes. By custom, a Justice will recuse if he heard the case in a lower court or represented someone in the case at some point during the litigation, but we all know that customs aren't laws. Kavanaugh is nominated for the Supreme Court precisely so that he can hear, cast a vote, and maybe even write the opinion for inconvenient legal kerfuffles that Donald Trump might find himself in.

Kavanaugh's clear partiality has been enough to derail other nominations (Remember Harriet Mier?), but the Republicans are desperate, and they're now resorting to these desperate measures to save themselves from the consequences of their corruption in the last 20 years. And who better than a man who's been in the middle of that corruption all that time?

when investigative matters involving them came before the court. In both cases the Justices voted against the president that appointed them.
