(1,822 posts)It is my opinion that the GOP is worried about losing the Senate and that the Dems wouldnt confirm anyone that Trump will nominate. So they will take the short term hit to pack the court for the next 30-40 years. Once the Dems are back in power the GOP will fire up their base and be back in power shortly after. So people thinking this could hurt the GOP are only thinking over the next 2 yrs, they're playing the long game.

(182,883 posts)First, Kavanaugh is purely a political operative. He's paid his dues in their minds.
Second, this would be a devastatingly embarrassing defeat for the Repubs which could really hurt their turn out in November. The believers could be so outraged by their seeming weakness that they don't turn out....OR it could energize them to turn out. With that group of whackos who knows.
Lastly, I do agree that they want to pack the court and they will stop at nothing towards that end.

(11,647 posts)... which would make it very hard for Collins and Murkowski to vote yes and even give a semblance of saving face. Although based on SUsan Collins'statements and actions during the Kavanaugh hearings, I am not sure how sincere she is on that issue...

Barrett, a longtime Notre Dame law professor appointed by President Trump last year to the Court of Appeals for the Seventh Circuit, in legal articles has backed a soft and flexible interpretation of the legal principle honoring Supreme Court precedents, stare decisis.
I tend to agree with those who say that a justices duty is to the Constitution and that it is thus more legitimate for her to enforce her best understanding of the Constitution rather than a precedent she thinks is clearly in conflict with it, she wrote in 2013 in the Texas Law Review.

He'll blame others for this failure of a nominee they picked. As long as he's still a nominee , it'll drag trump and the kgop down even more in the polls , and they will lose the Senate this Nov. . Vote these criminals out of office.

(54,443 posts)Kavanaugh will get his carefully edited script ("in order to put an end to this distracting partisan bickering, I will nobly withdraw my name, blah, blah..." ). McTurtle, Grassley, Hatch and Trump will decry the "witch hunt" by the "Democrat" Party, and quietly breathe a sigh of relief that it didn't end up with them having to defend Kavanaugh during a detailed televised hearing of the accusers the day before the midterms.
Trump will whine "witch hunt" as well, and then forget about it all ten minutes later, concentrating on what was REALLY on his mind, namely that tricky sand trap at the fifteenth hole.
I can see it playing out that way for sure. Trump will throw in a few gibes against whomever he blames at his rallies.
