(10,952 posts)is after the Trump Organization and Trump Family, Mueller should turn over everything that he has that NY could use. He should be looking at whatever else that he has that could be used by a state that would be interested in going after any of Mueller's targets. Whatever is removed from Federal Prosecution and is handled by the States is removed from Trump's pardon powers.

(22,037 posts)We have no idea what Robert Mueller has planned and organized. From his first day on the job, he has to have known that Trump's mercurial nature could result in closing down the investigation.
The corruption and criminality that the Mueller team has uncovered appalls Mr. Mueller, I hope. Perhaps he has constructed various "dead-man" switches in the event of his termination.
Mr. Mueller has been months ahead of the public and the only times we learn anything concrete is when there are court filings. In each of those, Mr. Mueller has knocked it out of the park. Let's see what happens.

(6,254 posts)court. I think its as simple as the Republicans know this maybe their last chance to put a conservative on the SC for a long time and will not let anything stop them. Still, Kavenaugh is dirty and cannot have a seat on the SC. Republicans would be smart to submit another name, an equally offensive person on ideological grounds,of course ,maybe even worse, but without the stench of Kavenaugh who will diminish the SC legitimacy and standing.

What his plans might not have taken into account was the possibility that the SC might end the Dual Sovereign doctrine so that states can not prosecute comparable cases if a President pardons someone. Should that occur, I would think that he would be better off giving states the first bite of the prosecutorial apple for whatever cases that fall within their jurisdiction which would have the impact of neutering Trump's pardon powers. If Kavanaugh gets on the SC, Mueller will have to play the game as best as he can to work around the various obstructions that are put in front of him.
In the end, does it really matter who carries out a prosecution if it results in a plea deal and/or conviction?

(42,770 posts)With tax evasion, there would be two cases right? One in Federal court for federal tax and one in state court for state tax evasion. Right? They aren't the same crime, right?
Say trump's main goal with kav is to protect Junior from going to jail. What would be an example of a crime he couldn't pardon him for?

I'm noting that even if they really wanted Kavanaugh seated the very first day, McConnell also had almost a month before the start of the term to confirm, so he had time for a more seemly procedure. Instead, he scheduled the vote for an eyebrow-hiking 8 days after opening the hearing.
As for their interest in overturning 200 years of dual sovereignty, which would help their current and future leaders get away with criminal behavior, what other goals do these bastards have? It's sure nothing to do with protecting us from double jeopardy.

If this is really what they are after, it is incredible malfeasance on the part of the media and the Democrats. They should be pointing this out and shouting it to the roofs! The case was added to the SC docket for this term THE DAY AFTER Kennedy announced his resignation.
WTF. The one thing the Democratic party really lacks is SCHEMERS. Someone who thinks enough about how the Gang Of Predators would try to screw Democrats over so that they could predict, advertise, and defeat these kinds of tactics. But once again, they are asleep at the wheel. Some of them are probably even going to vote for Kavanaugh, I wouldn't put it past them.

(7,142 posts)there were 2 systems of justice, one for the rich and one for the poor. Why don't they just pass a law that if you are a millionaire and up you can't be arrested for anything? The only reason that Bernie Madoff went to jail was because he stole from rich people.
When a judge lets a young rich kid off and uses the excuse that the kid suffered from "affluenza" that pretty much sums it up.

FYI... There are 3 branches of U.S. government: Executive, Legislative and Judicial. Here's a brief explanation of what the duty of each branch is per our Constitution.

The President of the United States administers the Executive Branch of our government. The President enforces the laws that the Legislative Branch (Congress) makes. The President is elected by United States citizens, 18 years of age and older, who vote in the presidential elections in their states. These votes are tallied by states and form the Electoral College system. States have the number of electoral votes which equal the number of senators and representatives they have. It is possible to have the most popular votes throughout the nation and NOT win the electoral vote of the Electoral College.
The Legislative part of our government is called Congress. Congress makes our laws. Congress is divided into 2 parts. One part is called the Senate. There are 100 Senators--2 from each of our states. Another part is called the House of Representatives. Representatives meet together to discuss ideas and decide if these ideas (bills) should become laws. There are 435 Representatives. The number of representatives each state gets is determined by its population. Some states have just 2 representatives. Others have as many as 40. Both senators and representatives are elected by the eligible voters in their states.
The Judicial part of our federal government includes the Supreme Court and 9 Justices. They are special judges who interpret laws according to the Constitution. These justices only hear cases that pertain to issues related to the Constitution. They are the highest court in our country. The federal judicial system also has lower courts located in each state to hear cases involving federal issues.

To quote from the opinion written by Justice Ginsburg:
"The double jeopardy proscription is intended to shield individuals from the harassment of multiple prosecutions for the same misconduct. Green v. United States, 355 U. S. 184, 187 (1957). Current separate sovereigns doctrine hardly serves that objective. States and Nation are kindred systems, yet parts of ONE WHOLE. The Federalist No. 82, p. 245 (J. Hopkins ed., 2d ed. 1802) (reprint 2008). Within that whole is it not an affront to human dignity, Abbate v. United States, 359 U. S. 187, 203 (1959) (Black, J., dissenting), inconsistent with the spirit of [our] Bill of Rights, Developments in the Law Criminal Conspiracy, 72 Harv. L. Rev. 920, 968 (1959), to try or punish a person twice for the same offense?"
If Ginsburg and Thomas are aligned on this issue then, one way or another, there is already is a majority on the Court to roll back the dual sovereignty exception.

(58,785 posts)reason all by itself to explain McConnell's attempt to ram the confirmation through in a highly questionable 8 days. Also, McConnell had most of a month to get him on before the term started.
Besides, Kavanaugh should be there for oral arguments, but were they scheduled for the first week?
No doubt he's wanted on the court for this reason also, however.
