(129,426 posts)The Constitution states that the Senate does "advice and consent". I.e., only the Senate will be involved in the confirmation process and this is part of the materials they would be offered to review for a nominee. The issue is whether they wait until the last minute to give it to the Democrats with little time to review like they did with the Shrub document dump the weekend before the hearings started.
The hope would be that Chris Coons would alert Flake of any beyond-the-pale shenanigans.
