Cloture votes aren’t always the same as the final vote.

Manchin has not said what his final vote will be. Given his protectiveness of the ACA it way well be a no.

You either let his nomination linger and allow McConnell to endlessly call votes on him, which is what happens if cloture fails, or you advance to a final vote and end it there.

Manchin typically votes with repubs when passage is already certain. Whether or not he is a yea on the final vote is dependent upon Flake/Collins. He won't be vote 50, but he may be 51-52 if passage is assured.

I don't recall now whether he railed against Manchin to his crowd, but I'm pretty sure I heard him mention Patrick Morrisey's name. Regardless, I can bet that when this confirmation is over Donald Trump will go full on to elect his republican opponent. Joe Manchin has no excuse voting to confirm Kavenaugh.


On the Republican side, Manchin is being challenged by West Virginia Attorney General Patrick Morrisey. In August 2017, Morrisey publicly asked Manchin to resign from the Senate Democratic leadership team. Manchin responded, "I don't give a shit, you understand?" to a Charleston Gazette-Mail reporter when asked about Morrisey's call. "I just don't give a shit. Don't care if I get elected, don't care if I get defeated, how about that?"[


There is one hope. We know Diane Feinstein will have words with him today. If there really is a blue wave this year, Joe Manchin can be cut out of the after party in the form of senate committee appointments. That will hamstring him in bringing home the pork.
