(872 posts)They're going to run those sentences concurrently. Hopefully I'm wrong, but I'll be surprised if he spends more than 5 years in jail.
But by all means, it's a victory, and better than the alternative.

Sec. 33-3. Official misconduct.
(a) A public officer or employee or special government agent commits misconduct when, in his official capacity or capacity as a special government agent, he or she commits any of the following acts:
(1) Intentionally or recklessly fails to perform any
mandatory duty as required by law; or
**** (2) Knowingly performs an act which he knows he is
forbidden by law to perform; or *****
By definition Murder 2 would be committing and act forbidden by law.

Also wondering about his sentencing. According to the Chicago Tribune, 2nd Degree murder has a 4-20 year sentence. Aggrivated Assault with a Firearm, 6-30, with mandatory 85% time served. He is guilty on 16 counts of aggravated assault. Will he serve those consecutively or concurrently?

(4,959 posts)It is as though the jury realizes that cops are sanctioned to kill innocent people, so this may not be 'official misconduct' based on precedence as far as police behavior, but it is still murder.
I'm probably wrong about that, and I don't know anything about what that charge really means, but that's where my weird mind took it.
