If they take back the House, I would be surprised if they dont put forth impeachment proceedings in the next Congress, Shugerman told The Washington Post. At the moment, according to the Cook Political Report, Democrats are substantial favorites for House control.
Even then, though, Shugerman called Kavanaughs removal exceedingly unlikely, given the supermajority threshold in the Senate. [Here are the House seats most likely to flip, according to election rating systems]
But there are 51 Republicans and 49 Democrats in the Senate, where Republicans maintain a 7-in-9 chance of keeping control, according to FiveThirtyEights calculations leaving no window for the Democrats to gain a supermajority, even in a best-case scenario.

(51,611 posts)encouraging calling, writing and protesting. A protest is currently underway and they will stay there until the vote tomorrow. The other PROTESTS are nationwide and in a planning stage their afternoon.

That process works no different than it does for a President or any other office holder subject to impeachment.
The House can impeach him if Democrats have a majority but it requires a two thirds majority in the Senate to convict in order for that elected official to be removed from their office.
Democrats do not have the votes in the Senate for a conviction so he would stay a Justice. The only result would be to stir up more rage from the right and spend political capital better spent elsewhere.
Kavanaugh committed crimes by lying to Congress. By knowingly receiving stolen documents. If there is a willingness to indict him by a grand jury, he can be arrested and go on trial and go to jail like any normal person. If he is indicted and convicted in court, republicans will have no choice but to vote to impeach him.

(714 posts)Impeaching without removal does nothing except poison the impeachment process in the public's mind and make them think the whole impeachment thing was just a stunt done for political purposes.
We've got a president who we've got a good chance of both impeaching and removing.
So why would I want to do something which would make the public more cynical about the impeachment process?
Impeaching and removing Trump (and perhaps other related elected officials) accomplishes something tangible and political. But impeaching Kavanaugh leaves him on the court making decisions for the next 30 years just as if he'd never been impeached plus makes it more difficult politically to impeach and remove other people in the future.
I have a tough time seeing that as being a step forward.

(7,541 posts)but if Dems take the House, the House Judiciary Committee investigates Kavanaugh for lying to Congress multiple times as well as lying to the FBI and profers the evidence to the Department of Justice. Not impeachment...indictment. Both are felonies and prosecution would only require evidence and a willing DOJ. His status as a seated judge has no bearing on bringing an indictment.

Asking essentially the same group of 90-plus senators who will also be around in the next Congress to vote to impeach Kavanaugh after they just voted to confirm him? Not going to happen. Sad but true.
