"No," Trump told reporters on the South Lawn when asked if he had received a subpoena from Mueller. The president was departing the White House en route to a campaign rally in Florida.
The specter of a presidential subpoena was revived earlier Wednesday after Politico published a piece from former federal prosecutor and former White House general counsel Nelson Cunningham, who suggested that Mueller has in recent weeks been locked in a battle with the White House over an effort to subpoena the president and get him to appear before a grand jury.

(1,180 posts)The apparent court filings, while sealed, are only open for conjecture. The legal minds Ive read seem to think that his lawyers are fighting a subpoena, so until theres a final ruling, he probably hasnt been actually served.

(53,342 posts)The evidence lies in obscure docket entries at the clerks office for the D.C. Circuit. Thanks to Politicos Josh Gerstein and Darren Samuelsohn, we know that on August 16 (the day after Giuliani said he was almost finished with his memorandum, remember), a sealed grand jury case was initiated in the D.C. federal district court before Chief Judge Beryl A. Howell. We know that on September 19, Howell issued a ruling and five days later one of the parties appealed to the D.C. Circuit. And, thanks to Politicos reporting, we know that the special counsels office is involved (because the reporter overheard a conversation in the clerks office). We can further deduce that the special counsel prevailed in the district court and that the presumptive grand jury witness has frantically appealed that order and sought special treatment from the judges of the D.C. Circuitoften referred to as the second-most important court in the land.
Nothing about the docket sheets, however, discloses the identity of the witness. Politico asked many of the known attorneys for Mueller witnessesincluding Jay Sekulow, another Trump lawyerand each one denied knowledge of the identity of the witness. (What, of course, would we expect a lawyer to say when asked about a proceeding the court has ordered sealed?)
But for those of us who have been appellate lawyers, the brief docket entries tell a story. Heres what we can glean:

(129,476 posts)but I don't think he has testified in front of a Grand Jury. Pence earlier claimed he wasn't even asked to be interviewed or something along that line that I saw posted on DU recently.
Of course the other one hanging out there who has been oft-mentioned and who has whined about probably being targeted for indictment, is Roger Stone (and his buddy Credico already did his time in front of the Grand Jury).

(3,428 posts)on his show about this. They both surmised that if Trumpass is the one who got subpoenaed, then he isnt Muellers target; they also surmised that if this is correct, then Mueller has concluded that a sitting president cannot be indicted.
How disappointed will I be if Mueller doesnt indict Trumpass
