That would be after the election and before he can be fired.
Even if they are still counting votes, when the polls close, he's free to act.

(7,800 posts)I've been saying this for weeks. I hope that he and Rosenstein decide to indict Trump as soon as the polls are closed everywhere. The indictments can always be added to later, as they were for Manafort.
If we can see the need for this, surely Mueller and his team have thought this thing through thousands of times already, and have developed a brilliant course of action. One certainly doesn't have to be very brilliant to defeat the fool orange emperor! Just smarter than him (what a low bar) - and just as ruthless!

(14,320 posts)and is ready to pounce if necessary. Mueller is not in imminent danger; Trump will try to fire Rosenstein and/or Sessions first. If that happens, the floodgates will open, indictments will be unsealed, various investigations will be farmed out to US attorneys in relevant states, and Trump will regret ever throwing his hat in the ring.
If I were Mueller, I would have at least three scenarios planned out: if the Dems take just the house, or take house and senate, or if Repubs hold both. Not that I know what each scanario entails, but it would make sense to plan for all outcomes since he apparently has to wait for the election. But I do expect him to act soon after the election for the reason you cited. Obstruction report at a minimum, if the Russia investigation needs more time; but I keep hearing that more indictments are imminent, with Roger Stone usually mentioned.

(5,499 posts)What time do the polls in Hawaii close? At that time he should make all indictments public. Major media outlets will still be awake dealing with the spin of the election. I think it's possible 45 will fire Sessions and Rosenstein on Wed morning, especially if the elections don't go his way.
