1. I don't know, but I do know that his original conviction counts as a prior criminal record

for purposes of sentencing on his guilty plea on the second batch of charges. Which makes the sentencing worse. As does the lack of proper cooperation. As does new crimes (lying to federal investigators/prosecutors).
