U.S. Border Patrol Detained U.S. Citizens for Speaking Spanish in Montana

For Ana Suda and Martha “Mimi” Hernandez, May 16, 2018, began like any other in Havre, Montana: work, school, and a trip to the gym once their kids were in bed. They stopped by Town Pump — a local convenience store — to pick up groceries. While in line, the friends were chatting in Spanish, just two people having an ordinary conversation. But the Customs and Border Protection agent standing in line behind them did not see it that way.

He demanded to know where Ana and Mimi were born. After they said they were born in Texas and California, he forced them to turn over their driver’s licenses. He detained them by his patrol car, in full view of neighbors, for an extended period before finally letting them return to their homes and families. Ana and Mimi walked away from the interaction humiliated and afraid that they might again be stopped, detained, and interrogated at any time.

When Ana and Mimi asked why they were being held, he answered unequivocally: Because they were speaking Spanish. Ana replied that she was a U.S. citizen and demanded to be released. But the agent refused to let them go.

This detention violated Ana and Mimi’s constitutional rights. The ACLU has filed a federal lawsuit on their behalf. Speaking Spanish is not against the law. In fact, there is no official language in the United States — Americans speak hundreds of different languages. Over 40 million U.S. citizens speak Spanish at home with their families, and tens of millions more speak Spanish as a secondary language. And Montana, like the rest of the country, is increasingly diverse in terms of race, ethnicity, and language.

Dad always hated those guys; the ones who became a cop mainly to boss people around, to bully and intimidate them. He despised those guys as much as the ass kissers who would drive home the rich kids in town for minor in possession (because of "their future," you know) and bust the poor kids. My dad did just the opposite, which is probably why he never got a promotion in 30 years. He said he might've never gotten a promotion, but at least he could sleep at night or look in the mirror. I miss him every day.

how are Puerto Ricans dealing with this? They are born citizens and should really be pissed if they have to prove it just because they like to speak Spanish.

I remember in schools and in the Army when Spanish speakers would be in their little groups and some of our monolingual assholes would swear they were plotting against us.

Could we organize our multilingual citizens to break out in foreign speak at random times? Wear buttons and badges saying "Ich bin ein Berliner" Vive la France" "Cuba Libre"...

Two women in an airport giggling in Portuguese or two men whispering in Arabic...

We haven't learned from the Chinese Exclusion Act or Japanese internment camps (while German American Bund members were free to stink up New Jersey and Yorkville)

ICE has limited authority to conduct probable cause immigration stops inside a 100 mile wide band along the entire border of the US, including with Canada, Mexico and even along the coasts.

There are at least 2 areas in IA with strong Dutch heritage--NW IA and area around Pella.

I read that in NE around the time of WWI the state outlawed conducting church services in German.

Being bilingual or polyglot was always seen as a sign of superior schooling, money, and intelligence. George Washington's education was not as good as some of the other founding fathers, so he was one of the few who did not speak other languages.

I work with many Spanish-speaking families, and I always express good-natured jealousy that their kids will be bilingual and I am about half-fluent in Spanish. My retirement plans include immersing myself in the language as much as possible so that I can speak fluently.

When I read on DU last year that ICE or the Border Patrol can ask ANYONE for proof of citizenship I got a wallet size passport card and carry it in my wallet all the time now. I do not trust these shitheads a bit. My friend's husband was a Border Patrol agent 25 years ago and left as soon as he could retire I am happy to say. They stuff he told me, even from back then, was sickening. A lot of people, especially men it seems, let any power of authority go to their heads and act like Nazis.

It does not come from America. It comes from an island nation in Europe.

Klingon is more of an American language than English is.
