It's an appellate court. The case is filed in a United States District Court. It would be appealed to the 9th Circuit (assuming the court of original jurisdiction was within the 9th Circuit). In the federal courts there is no "Appellate Division" which he alluded to in his press conference. There are 94 District Courts, which each fall into one of 12 Circuit Courts of Appeal, and the US Supreme Court.

There is an appellate division in the New York State Supreme Court, which is the trial court. What we think of as the Supreme Court is called the Court of Appeals in New York. Given that he's hell bent on stuffing as many fascists onto the federal courts as possible, you'd think he'd at least have someone explain to him how they work.
