(1,262 posts)Why not wait until late summer/early fall of 2020, in the middle of the Presidential campaign, before the Senate can hold a trial, in order to do damage to Trump's re-election bid?
If the House impeaches now, that will either result in Trump not getting convicted (or even tried) in the Senate (bad for us; good for Trump), or, if the Senate tries and convicts, that will give Pence (or whoever the nominee is) time to do damage control.

(8,923 posts)I'm not an expert on the constitution but pretty sure it says if the House impeaches there is supposed to be a trial in the Senate presided over by the Chief Justice of the United States.
Now, with that said, you may be right in the sense the Republicans haven't followed the Constitution on much of anything, so, not sure why this would be any different. Just something else that has to go through the court system while Trump and his lackies run out the clock.
Bettie
(16,110 posts)we're assuming that rules and even laws mean anything to them.
They don't.
I honestly don't think that they will even obey court orders anymore. Barr has essentially told them that they now get to do whatever they want to and with the DoJ 100% corrupt, there is no rule of law anymore.
ooky
(8,923 posts)comply with the constitution and just keep on with their obvious strategy of kicking it to the courts and running out the clock. Its very obvious that Barr is a fascist supporting a fascist dictator. That is what our government is now. We can see this taking place before our very eyes. Unfortunately, it is becoming all too clear that the only way we will get rid of this shitshow is to win the Senate and the House in 2020 and impeach and convict him then. Otherwise, everybody may as well learn how to ride this poop wave.
Bettie
(16,110 posts)the investigations and hearings with regard to impeachable offenses.
That's the only way they might possibly get the unredacted report.
Need a day to process...but I'm really afraid that we're about a step away from dictatorship.
ooky
(8,923 posts)Functionally, I feel this is already a dictatorship. When the President can do anything he wants and get away with it, that's dictatorship.
Bettie
(16,110 posts)our system only works when there is some expectation of a minimum level of ethics from all participants.

(261 posts)Somebody around here needs to do that. I have been reluctant on the impeachment move for quite a while. But this so clearly demonstrates hes either unwilling or incapable of upholding his oath of office that he is endangering our democracy. We all knew this. But here it is in black and white. Dems should move now even if the Republicans wont convict. And by some miracle and they did, making Pence President, even then. Pence could be far worse as a president because hes a wolf in sheeps clothing. But this is our constitutional duty.

Definite obstruction. Loyalty to the President above loyalty to this Nation and its laws.
At a minimum, the country needs to know how far a President can go to protect himself from at least embarrassment and ridicule (he was duped, a useful idiot) and at most committing illegal acts (he knew everything).

(1,977 posts)They would love nothing more than for us to start the impeachment right now and have them nope it. Waiting lets this hang in the balance and lets us beat him up with it. You hold impeachment now and the senate nopes it then you are trying to sell that everyone in the government is corrupt... Which is exactly what they want you to say.
There is no path to impeachment and conviction. Keep this thing hung around his neck.

(8,678 posts)This issue so important that it does not matter in the least what Trump or the GOP will do or might do. What they think or what they will do should not enter into our minds. They are criminals and they are corrupt. We need make it clear that we as Democrats take this seriously and will try to stop him with whatever power we have and we do have the power to impeach. I agree there may be no path to conviction but we do have a path to impeachment. Lets take it.

(6,228 posts)Watergate investigations were going on during Nixon's second term reelection campaign. He won in a landslide winning 49 out of 50 states. McGovern won 1 state (MA) and Washington DC. Watergate investigations continued. After the majority of the country believed that Nixon should be impeached, Goldwater went and told Nixon it's over. His choice was to either resign or be impeached by the House and tried & found guilty by the Senate. Nixon chose to resign. I wish we had a Senate that will do it's job. If trump loses the Nov. 2020 election, he will have to answer to the other 14 investigations going on now. We should just let the election play out.

(1,292 posts)Trump would claim that the Democrats were being partisan and that he'd been "exonerated" by not being removed from office. After the Republicans impeached Bill Clinton, he became more popular. Obviously, the charges against Clinton were frivolous and Trump is a corrupt traitor, but a large chunk of the population is brainwashed and not very bright.
If the point of impeachment is to draw out evidence in public hearings, can't that be done through other types of investigations. Impeachment proceedings lead to a referral to the Senate and will get shut down there.

(1,292 posts)Unless Trump has been damaged to the point where a significant number of Republican Senators would vote for impeachment, I think it's better to keep that bullet in the chamber as a threat. Once it's been fired and rendered useless by the kevlar Senate, I think Trump could be emboldened to be even more extreme, because there may be less public patience for a 2nd set of impeachment proceedings.

(36,060 posts)They won't need any more testimony for starting impeachment proceedings at that point. The full Mueller Report will have it all.
The only testimony they'll need is Mueller's.
When impeachment indictment passes the House, then fails to get tried by the Republican Senate, no one will have sufficient standing to make their arguments to the SCOTUS.
Even if some organization gets standing to make their case before SCOTUS, SCOTUS will dismiss their case, knowing it would not rule to remove a president, imo.
Nevermypresident
(781 posts)must do what the framers of our Constitution provided as a remedy. It's evident that Mueller has handed this over to Congress (IMO he was pressured).
For those swing voters who won't bother to read the redacted Mueller report, I believe many would tune in to the Judicial Committee's open impeachment hearings and get the depth of the corruption, abuse of power, and obstruction done by this amoral, above the law president. If the House ends up sending it to the Senate for the trial and trump skates, Republicans may face a backlash from these voters.

(2,785 posts)the argument that we should just let the voters decide in 2020, because we don't have the numbers in the Senate should be officially dead now. Part of our message will be Trump is corrupt. Then casual and swing voters are going to ask if he was really so corrupt why was he not impeached? The time for excuses are over the house must have the courage to impeach Trump.

(2,559 posts)1) Impeachment is basically a political process. It was for Johnson, it was for Clinton, and no doubt will be for Trump.
2) Hold the hearings on the Mueller Report now. Call in Mueller, etc. Get those tax records. If the hearings last through 2019, even better. Then in 2020, draw up the articles of impeachment. Give them to the Senate around the start of summer.
3) McConnell will be on the defensive because twice as many R Senate seats will be up for grabs as D seats. If he refuses to bring the impeachment to the floor for a trial, he loses. The Senate will go D in 2020.
4) If Trump is re-elected (doubtful at this point), then use the new D Senate majority to hear the impeachment charges.
5) If Trump is not re-elected, turn over the case to the new AG and/or the SDNY to pursue criminal charges.
The best scenario is that the House weaponize the Mueller Report both to diminish Trump's chances of re-election, as well as bring in more Dems in the House and Senate. Trump not re-elected, and a solid Dem government.
And then we can begin the healing process.
