(4,533 posts)Judge Nap has a powerful 4 minute segment on Fox, welcome to my chambers, filmed on the street outside Fox News, claiming Trump obstructed justice. Dershowitz, who is smarter than you are and smarter than I am, has a decent argument that many of the acts Nap discusses arent crimes if the President does them. A prosecutor has discretion on what to prosecute. Most of the job of a prosecutor is deciding not to prosecute. Without those decisions not to prosecute life would be hell, we would be in a tyranny. Everyone breaks many laws. And the President is the top prosecutor. He has the right to decide not to prosecute Flynn. He decides whether Mueller should be fired. So okay maybe Dershowitz is right. I went to a top law school, I had the highest LSAT score there. And if I disagree with Dershowitz I think the smart money should bet on him against me every fucking time. I have read hundreds of things he has written. IMO he is way way smarter than I am, way way more likely to get the law right. So lets agree he may be right that if the President does it it isnt obstruction. Except one conclusion of Nap doesnt actually disagree with Dershowitz. Trump ordered McGahn to lie, to write a false memo that Trump did not order him to tell Rosenstein to fire Mueller. Ordering someone to lie about a matter likely to be part of a government investigation is not part of a Presidents job. Stopping a prosecution, yes. Firing anyone, yes. Ordering a witness to lie? No. So under any legal view Nap is correct saying Trump has obstructed justice.
