The burden of proof changes. The ability to obtain evidence changes. Yada yada.

Every day, Trump is crashing and breaking the Constitutional order.

While we dither.

In fact, there really isn't any burden of proof in an impeachment inquiry or in oversight

And the ability to obtain evidence doesn't change either. Congress power to obtain evidence is the same whether it's being sought in connection with impeachment or for oversight. Adam Schiff just said the same thing on Rachel Maddie.

There is really no difference between impeachment and other oversight proceedings when it comes to obtaining testimony and documents.

He added that it may be possible to argue to a court that, if a president can't be indicted and the only way to hold him accountable is through impeachment and ask a court to order production of documents if an impeachment inquiry is opened. But he was clear that there is nothing special about an impeachment inquiry that gives Congress access to anything it otherwise wasn't entitled to.
