(17,984 posts)I just don't understand why we have to walk around on pins and needles like if we do the right thing the world is going to end. So instead, we do the wrong thing. We don't follow through on the threat. We don't do what is lawfully correct. Doesn't that make us complicit?

(14,249 posts)Inherent contempt requires a process for the issuance of the contempt citation. If the Dens followed the "letter of the law," there's no way it would be possible to complete the process and Mnuchin to be in jail a mere three hours after a deadline for responding to a subpoena passed.

(18,486 posts)In fact, the letters, etc. that people have been disparaging here are an essential part of the process you're calling for. They are now in a position to charge him with contempt and make it stick.
But yelling to "Start the damned process" three hours after the deadline passed is really over the top. People need to calm down and let these people do their jobs.

Under this process, the procedure for holding a person in contempt involves only the chamber concerned. Following a contempt citation, the person cited is arrested by the Sergeant-at-Arms for the House or Senate, brought to the floor of the chamber, held to answer charges by the presiding officer, and then subjected to punishment as the chamber may dictate (usually imprisonment for punishment, imprisonment for coercion, or release from the contempt citation).[10]

They can't just say, "He didn't meet the 5:00 deadline! Arrest that man NOW!" It doesn't work that way.
Just calm down and let them do their jobs!

(18,486 posts)But they can't just go to court because they want to and expect a good outcome. The courts require certain things prior to entertaining a case.
For example, before a court will issue and enforce a contempt citation, it usually will require that the petitioner show that it has "exhausted all remedies"- meaning that they have made all reasonable efforts to compel cooperation prior to going to court. That's one of the reasons that Nadler, et al are "asking nicely," then sending the much-criticized "strongly-worded letters" and giving Mnuchin and others plenty of opportunity to comply even after the deadlines have passed. It may be really frustrating to lay observers who think they're being weak or dragging their feet. But if they don't do it this way, a judge is very likely to tell them to go back and do all of these things and then toss them out of his/her courtroom for wasting the court's time. They have to show that there's no other possible way to get the testimony or documents they want and someone just saying "no," isn't enough, regardless how obnoxious and blatant they say it.
They have to follow the steps and that's what they're doing.

It doesn't take more than a look for my kiddo to fall in line. Just throw the book at a few of these assholes!! Come on!!! What are waiting for?
