Children born to U.S. service members and government employees overseas will no longer be automatically considered citizens of the United States, according to policy alert issued by U.S. Citizenship and Immigration Services (USCIS) on Wednesday.
Previously, children born to U.S. citizen parents were considered to be residing in the United States, and therefore would be automatically given citizenship under Immigration and Nationality Act 320.
Now, children born to U.S. service members and government employees, such as those born in U.S. military hospitals or diplomatic facilities, will not be considered as residing in the U.S., changing the way that they potentially receive citizenship.

(532 posts)The OP implied that Whites won't be affected. The policy dramatically effects career military officers and foreign service people, who are predominantly White.
I think the prick is striking at John McCain in the grave. McCain was born in the Canal Zone of Panama.

McCain would be 100% in the clear because of specific law regarding the Panama Canal Zone.

(42,714 posts)While I'm not saying the changes announced are good or a correct interpretation of the statute, they do not apply as broadly as the OP article (and many other articles) suggest. The provisions in question only apply to a limited number of situations in which a child born outside the US to US citizens does not acquire "citizenship at birth." Those situations include adoptions and the rare circumstance in which the child's parents didn't not live continuously in the US for at least one year at some time before the child's birth.

(42,714 posts)One example given in the guidance involves a U.S. citizen who may have automatically acquired U.S. citizenship based on birth in the United States, but never actually resided in the United States. This U.S. citizen will not have established residence in the United States, and may be unable to transmit U.S. citizenship to his or her own children.
On the other hand, the guidance does not apply to the following situations: a child born outside the US to parents both of whom are citizens of the United States and one of whom has had a residence in the United States or one of its outlying possessions, prior to the birth of such person and to a child born outside the the United States where one of the parents is an alien, and the other a citizen of the United States and where, prior to the birth of such child, the citizen parent was physically present in the United States or its outlying possessions for a period or periods totaling not less than five years, at least two of which were after attaining the age of fourteen years. That's going to cover most situations. And in those situations, being a government employee or serving in the military overseas counts as "physical presence."

The next President should not only reverse the policy and make everyone affected by it immediate citizens, that President should also force Congress to pass a constitutional amendment and send it to the states for approval.
