Maurice the rooster wins court battle over noise with neighbours

A French court has ruled in favour of a cockerel owner after her bird's early morning crowing provoked a noise pollution complaint from neighbours.

Maurice, who roosts on the picturesque isle of Oléron off the Atlantic coast, was accused of disturbing a retired couple who own a holiday home nearby.

News of his legal troubles flew around the world, gaining him a flock of supporters.

His owner, Corinne Fesseau, was cock-a-hoop at news of the ruling.

"It's a victory for everyone in the same situation as me. I hope it will set a precedent for them," she was quoted by AFP news agency as saying.

Wife has about 100 chickens and sells free range eggs at the farmer's market. Every once in awhile one of her "pullets" turns out to be a boy. You just block all that morning noise out like background after awhile, just like car noises in the city.

I was ecstatic when they moved. 4:30 AM, every fucking day. It would then get their chickens squawking and the neighborhood dogs barking. I couldn't even sleep with my windows open.

Did I mention I live on 3 acres and their house is 80-100 ft away and filled with trees?

and traffic on the street and the call to prayer five times a day when I lived/worked in the Middle East.

Not everyone can do so, I suppose, but letting oneself become overly irritated by it all but assures that we can't.

I became irritable because I didn't get more than 6 hrs sleep a night. The only way I could sleep through it was to take sleeping pills.

The couple who took her to court live in the city but visit their vacation home and don't want any noise.

if this has become international news.

I think this is discrimination. If it were a barking dog, the court would not have ruled the way it did. It is fowl-privilege and nothing else.

My mother had a pet rooster up until a few years ago, a Dutch Bantam, small and friendly. It was murdered by the next door neighbor, because it "woke [him] up too early crowing." Mother has dementia now and frequently asks about her pet, who used to ride on her small tractor with her while she tended her garden, was mostly silent and liked to sleep in the tree outside her bedroom window.

Though he has admitted to the crime there's little we can do to find peace for mother. Though she does like to feed the many crows that visit the front yard.
