Texas Ranger says ex-Dallas cop who killed Botham Jean was reasonable to feel threatened, but a jury won't hear it
By Eliott C. McLaughlin, CNN
Updated 1812 GMT (0212 HKT) September 25, 2019
(CNN) A Texas Ranger who investigated the Botham Jean shooting said Wednesday that the ex-Dallas police officer who killed Jean in his own apartment was reasonable to think he was a burglar.
In fact, Sgt. David Armstrong said, the investigation leads him to believe authorities had no probable cause to arrest Amber Guyger for any crime.
"I don't believe that (the shooting) was reckless or criminally negligent based on the totality of the investigation and the circumstances and facts," Armstrong said.
District Judge Tammy Kemp did not allow Armstrong to deliver the testimony to the jury, saying she would not let him speak to the reasonableness of Guyger's actions on the night of September 6, 2018.
Though prosecutors allege Guyger murdered the 26-year-old accountant, her defense team has said she simply walked into the wrong apartment and fatally shot Jean after mistaking him for a burglar. Jean's apartment was on the floor above Guyger's.

Bodycam video played at Amber Guyger trial shows chaos, attempt to revive Botham Jean
"I thought it was my apartment," Guyger is heard repeating in the dramatic bodycam video, which was shown at her murder trial in Dallas.

The chaotic aftermath on the night a Dallas police officer fatally shot her neighbor mistaking his apartment for hers and believing he was a burglar was shown for the first time in court Tuesday.
Amber Guyger, who was fired after the shooting, is seen in the apartment of her neighbor, Botham Jean, briefly in one of the bodycam videos on the night of Sept. 6, 2018. Guyger was off duty but in uniform when she got home to her apartment complex, where she had moved in two months before.
"I thought it was my apartment," Guyger is heard repeating.
When the arriving officers ask her where Jean was shot, she replies: "Top left. Top left."
"Hey, can you hear me? Talk to me," one responder asks of Jean. His body is seen on the floor with blood pooling around his left shoulder.

Not once has he wandered into our neighbors place.
If a little child knows his own place from other look alike units in the building then she sure as fuck should have.

and shoot them dead without looking criminal or even unreasonable -- just as long as I claim to have been confused about where I was? What could possibly go wrong, if we adopted that as a legal principle?

It also helps if you're white and your victim isn't.

Why the fuck didn't she exit the apartment and call for backup?
