(5,387 posts)the victim would have been justified in shooting her, I suppose.

(82,849 posts)She picked up a pro bono folder and had an interview with the defendant. He told her that, when it came right down to it, the other traffic at the stop light he ran really should have seen that he wasn't going to stop and that he wasn't going to stop just as they got their green light. So, you know, shouldn't they be on the hook for not keeping a proper lookout for other traffic?
My friend listened to him spin out this novel legal theory, and said, "So what you're saying is that you should be allowed to drive any way you want, blow through stop signs and red lights, and it's up to everyone else to watch out for you?"

We are in a serious situation where the cuckoos in the clock want to ignore the purpose of the mechanism and determine the time based on their own gut feelings - and personal interest.

(5,810 posts)and just couldnt imagine it. Even twisting the logic like a pretzel. She was the one wrong at every step of this terrible tragedy. The victim made no mistakes other than being home at the wrong time....sadly for him. Every decision she made fell on her shoulders. So how could a jury not find her guilty? And also not working in her favor was the fact that she was a police officer, allegedly trained in decision making steps before using your weapon. So there were not a lot of excuses for her to utilize in her defense.
Guilty. Yes, she was.
Now comes sentencing. She could get 99 years but I do not think she should receive that. A lengthy time behind bars is fair. But life? No.

(146,255 posts)You are correct, though. Reason and logic were rightly used in this case, and recognized by the jury. Any reasonable person would have recognized that the apartment was the wrong apartment. That should have ended the incident immediately. The decision to pull a pistol and shoot demonstrated a depraved lack of reason on her part and a completely innocent man died.
