(18,486 posts)It's a request for declaratory judgment and injunction - they're seeking a court order enforcing the subpoenas.

(8,844 posts)they are totally ignoring the constitution now, what makes you think they wouldn't steam roll that too.

(8,844 posts)I am old and do not have the time or energy to do the research to present what I find to you.....
HOWEVER, what comes to mind first is the 2000 Presidential election where they had no right whatsoever to intervene in the State of Florida recount that was demanded by the state of Florida. There is nowhere in the U.S. Constitutuion giving them the rights that they usurped to decide that W "won"........
Or deciding that a Corporation or worse yet a foreign country, even a country not an allie has the right to freedom of speech, just like a U.S. resident/human being in 2010...........

(2,146 posts)What court upholds that jailing? Due process applies to dirt bags as much as it does to non-dirt bags.
They'd be released in 11 minutes...and the optics...hand the pukes a campaign add..."The Democrats are jailing us for asserting our Constitutional rights...what's next, denying us 5th Amendment protection"
There isn' a Democratic Hose Chairperson that is going to pull the IC trigger...their lawyers know a crap ton more than you do.

(18,486 posts)A lot more effective than trying to do inherent contempt, no matter how satisfying the "lock 'em up in the basement" crowd may think inherent contempt may be.

(18,486 posts)Ross and Barr to comply with the subpoenas. The court no doubt will issue such an order - and if they defy it, they'll be in contempt of court, which is much more serious and has a stronger enforcement mechanism than contempt of Congress does.

(18,486 posts)The Committee isn't suing for damages, but asking the court for an declaratory judgment and injunction against Barr and Ross. In short, they're asking the court to enforce the subpoenas, as they've done in other cases, including the case that was decides yesterday.
