Assemblyman Brian Kolb was arrested and charged with misdemeanor driving while intoxicated following an Ontario County crash on New Year's Eve.

Deputies responded to a crash at 7980 County Route 41 in Victor at 10:27 p.m. Tuesday and identified Kolb as the driver of the 2018 GMC Arcadia involved in the crash. No one was injured and no other vehicles were involved in the crash.

Kolb was in the vehicle in a ditch in front of his home when the deputy arrived, Ontario County Sheriff Kevin Henderson said. Kolb was cooperative with deputies, Henderson added.

Kolb was driving a vehicle registered to New York state, Henderson said.

Kolb failed a field sobriety test and was then taken into custody, Henderson said. While at the Ontario County Jail, Kolb was given a Breathalyzer test, which revealed his blood-alcohol content was over 0.08%, Henderson said.

Kolb, who was charged with DWI and unsafe turn, was processed at the Ontario County Jail and is scheduled to appear in Victor Town Court at a later date. Henderson declined to reveal where Kolb was headed from or how far he had traveled.

On December 24, the Daily Messenger newspaper published a column by Kolb urging people not to act like he would a week later.

“Many of our holiday traditions, especially our New Year’s Eve celebrations, involve indulging in spirits. Done safely, and in moderation, these can be wonderful holiday experiences,” Kolb wrote.

“Do not operate a vehicle if your ability to do so is impaired,” he urged. “Drunk driving is not only dangerous to the driver, but to vehicle passengers, bystanders and other drivers.”

and drank and drove I would be fired. Besides, I'd rather drive my car given the garbage vehicles my department has.

Second chances, third chances, heck, Republicans are a bunch of softies when it comes to lapses in judgment and errors like this. Nothing untoward will happen to Kolb.
