The Senate is not on trial here, as much as it should be. Roberts is really just a moderator, his only job is to enforce order and the Senate rules, he doesn't control what those rules are.

Judges often admonish both sides when one side engages in problematic courtroom behavior. This eliminates any suggestion of bias. The upside is judges are unlikely to forget, and once an attorney loses his or her credibility in the eyes of a judge, he or she is unlikely to regain it. Falsus in uno, falsus in omnibus.
