The thought was this was going to go down party line and the law would stand, hope that's not the case.

So there are 6 Justices deciding the case - 3 Ds & 3 Rs. But one of the Rs (the Chief Justice) is a more moderate R and some of the moderate R pundits (like Smerconish who is also a lawyer and knows him well) thinks he may tip it to the Ds. Am crossing fingers.
