During teleconference with governors, Trump once again called for a ban on burning the US flag





I’m told that on his call with governors and others, Trump is, yet again, calling on a ban against burning the US flag.

The only way to achieve this is an amendment to the constitution as the US Supreme Court has repeatedly ruled that a ban would be unconstitutional




Editing to add, per a tweet from a HuffPo reporter, that Trump apparently wants governors to pass state laws banning burning of the US flag:





Trump is now telling the governors they should pass laws criminalizing the burning of the American flag.

“We have a different court. It’s time to review that again,” Trump said, according to a source. “If you wanted to try a very powerful anti-flag burning law, we’ll back you.”

How about an amendment banning any civilian from rendering the military salute?

May only be approved on Festivus Day.

Texas v. Johnson

Texas v. Johnson, 491 U.S. 397 (1989), was a decision by the Supreme Court of the United States that invalidated prohibitions on desecrating the American flag, which at the time were enforced in 48 of the 50 states. Justice William Brennan wrote for a five-justice majority in holding that defendant Gregory Lee Johnson's act of flag burning was protected speech under the First Amendment to the United States Constitution. Johnson was represented by attorneys David D. Cole and William Kunstler.

no longer wear the flag as clothing or use its likeness on other personal items ? (Vehicles, weapons, etc.)

I don't think overturning the prohibition on flag desecration would only apply to just burning the flag.

How Not to Display the American Flag

The flag and its likeness should be treated with respect. Its image should not be cheapened or tarnished by improper use.

The flag should not be dipped to any person or thing, including government officials—even the President.

The flag should never be displayed with the union (stars) down, unless as a signal of dire distress.

The flag should never touch anything beneath it, such as the ground, the floor, water, or merchandise.

The flag should never be carried flat or horizontally, but always aloft and free.

The flag should never be fastened, displayed, used, or stored so that it might be easily torn, soiled, or damaged in any way.

The flag should never be used as covering for a ceiling.

The flag should never have anything placed on it.

The flag should never be used for any advertising purpose, nor embroidered on cushions or handkerchiefs, printed on paper napkins or boxes, nor used as any portion of a costume.


Codes and rules stand - but laws against the use of "speech" are specifically protected.

those who turn the flag into clothing just don't understand the purpose of the flag ... sigh
