Trump's brother files new lawsuit to block niece's book


President Trump's brother filed a new lawsuit to block the publication of their niece's upcoming book about the president after a judge in another court blocked his efforts.

Robert Trump's newest suit, filed in the Dutchess County Supreme Court in New York, alleges that Mary Trump's tell-all book would violate a nondisclosure agreement.


The suit hinges around a 2001 agreement signed after a legal battle over Fred Trump Sr.'s will, with Robert Trump saying the agreement bars members of the family from writing about their relationships with each other.

This book must be a doozy if the family is so hell bent on trying to prevent its publication.

It only makes me want to read it even more.

Will Mary's book expose them for it? Cohen's? Others coming forward? trumps brother , and likely sister should be scared of what is about to happen to them. Investigators will eventually look over every member of that family with a fine tooth comb . They should all be scared now after trump gets ousted, while he may try to resign with a pre-planned pardon for him which will fail. Is this the reason trumps brother is so scared and trying to get it stopped? They should be very worried what's coming. Barr is finished and already in deep , deep trouble. Destroying evidence next? They will fail trying to stop it , no matter what a judge rules.

that will have to obey it for the rest of their life. She did not sign it and if she did she was more than likely underage and would not hold in court.

The NDA was entered into in 2001, according to the article. Mary Trump is now 55 (IIRC) and would have been 36 at the time of signing.

Regardless, my guess is that the NDA has a liquidated damages section. If it doesn't then the plaintiff has to prove damages. I don't see how they can get an injunction, unless the NDA specifically said that is the only remedy.

For example, the contract could read that, in the event of a breach, the person agrees to pay $1,000,000. Once a breach is proven in court, the person in breach must pay the other party that flat amount.

In a contract without a liquidated damages clause, the wronged party must prove the nature and extend of the damages and the court calculates the appropriate remedy based thereon.

Liquidated damages clauses aren't sacrosanct. A court can void one if it deems the liquidated damages clause is excessive, unrelated to the actual nature of the damages and thereby constitutes a "penalty" and not truly compensation for damages resulting from the breach.
