Whether McConnell can line up all the votes he needs to confirm Trump's nominee remains to be seen. But the bottom line is, there's simply no way a Supreme Court packed with conservative ideologues can coexist with an overwhelmingly diverse and increasingly liberal American public. It simply cannot stand.
If Republicans refuse to follow their own precedent about not filling a Supreme Court seat in a presidential election year, as they appear poised to do, Democrats will have no choice but to expand the court as soon as they are granted the power to do so by the American people.
That could be as soon as November with the potential elevation of former Vice President Joe Biden and Sen. Kamala Harris to the White House and Democrats reclaiming the Senate majority. As I wrote following the confirmation of Brett Kavanaugh to the high court: "Our elected leaders are the recourse. They have to and can serve as a check on a Supreme Court thats severed from prevailing public opinion in the same way President Franklin Delano Roosevelts court-packing threat to a right-leaning Supreme Court did in 1937. Electoral redress isnt a sure bet, but its a fair prospect when the vast majority of Americans agree on the issues, see the threat that is posed to the foundations of our democracy, and engage in the hard work of generational change.

I think it's important that this discussion be brought into the light. Republicans need to know that Democrats can and will fight back against McConnell and his fascism.

(6,098 posts)what credence can be given to us after this? Biden must appoint more justices, we have to neutralize the republican party once and for all. Eleven justices. A real tribute to RBG. Her dying wish was her seat not be filled until after the election. It's the least we can do for her and for the country.

(2,286 posts)What little we know if the minimal background check they did on kavanaugh is this...
1. He mysteriously payed off more than a years salary (over $250,000 in debt with no explanation of an economic windfall that could legally explain it.
2a. It was a bribe -- charge, impeach, and remove him
Or
2b. It is felony tax fraud -- charge, impeach, and remove him
That is even without all the Deutsch bank shenanigans involving Scalia.

(484 posts)Part of me is all in for expanding the court, but wont that just give the Repubs cover to do the same the next time they have a majority?
Didnt Mayor Pete have a complex, but fair and stable, proposal for expanding and maintaining balance in the courts? I skimmed his idea back during the primaries but dont remember the details. I think we need to do something similar if we get control of Congress and the Presidency whether or not McConnell pushes through another rwnj justice.
We need to stop the rampant politicization of our courts!
