The white teenager accused of fatally shooting two demonstrators and injuring a third in Wisconsin in August will not be charged with gun crimes in his home state, an Illinois state prosecutor announced.

Kyle Rittenhouse, 17, faces six criminal counts in Wisconsin, including first-degree intentional homicide. He allegedly used an AR-15-style rifle during protests in Kenosha, Wisc., that erupted after the police shooting of Jacob Blake.

Lake County, Ill. State's Attorney Michael Nerheim's office said in a statement that an investigation conducted by local police "revealed the gun used in the Kenosha shooting was purchased, stored and used in Wisconsin."

"Additionally, there is no evidence the gun was ever physically possessed by Kyle Rittenhouse in Illinois," the state's attorney's office added.

Police in Antioch, Ill., led the investigation. Antioch is Rittenhouse's hometown, which is located about 15 miles southwest of Kenosha.

He had is own police cover up killing of a 15 year old boy Justus Howell in 2015.


Now, LaToya Howell asking prosecutors to reopen the case – and take another look at the officer’s actions. She spoke Monday to CBS 2 Political Investigator Dana Kozlov.

“I did not want my son to become a statistic,” LaToya Howell said.

It has been five years since Zion police Officer Eric Hill shot and killed LaToya Howell’s son Justus on April 4, 2015 near 24th Street and Galilee Avenue. A home security camera captured the moment Hill fired the first of two shots.

Ultimately, investigators ruled Officer Hill was justified, and Lake County State’s Attorney Michael Nerheim said Hill “only fired when he thought his life and the life of his fellow officers were in danger.”

It’s a narrative that Justus Howell’s mother rejected from day one.

He's being housed in Illinois because he's fighting extradition to Wisconsin. His charges are in Wisconsin.

There's either evidence he had the gun in Illinois or there is no evidence.
Without any conspiracy required, they didn't file charges because there was no evidence of a crime.
