Reduce the size of the court down to 7. Kavanaugh and Gorsuch are gone. Now increase it back up to 9.

(9,202 posts)Reducing the number of seats to seven wouldnt force justices out. It would mean the next president could not nominate a new justice if one died or retired until the court got down to six sitting justices.

(15,002 posts)3 leave. Once they are on, they are on, even if the numerator exceeds the new denominator (I.e. 9/7). Impeachment and removal, resignation, death. Those are the way to get them off the court.

Frankly, I'd rather see three or more panels running to hear more cases and make each justice less vital to the balance.
