(2,856 posts)After Biden's overwhelming victory his first act should be to instruct congress to expand the supreme court. Then, they should impose term limits on the supreme court. Then, they should tell all that claim to be republican to go fuck themselves.

(12,449 posts)term limits isn't without a Constitutional Amendment, which requires 2/3rds of the Congress and 3/4ths of the states to ratify, which means any 13 states can kill the amendment.

(2,083 posts)Lifetime terms are not specified in the constitution, only that the justices "shall hold their offices during good behavior". Under this language, they could be transferred to an appellate court role after an SC term that was limited to, say, 18 years. Much good info on the constitutional issues can be here: https://fixthecourt.com/fix/term-limits/

(12,449 posts)The Constitution does prescribe a method to terminate the lifetime appointment of a Supreme Court Justice. That method is impeachment.
Article III of the US Constitution created the Supreme Court and gave Justices and other federal judges a lifetime appointment. Section 1 states in part, The Judges, both of the Supreme Court and inferior Courts, shall hold their Offices during good behavior

(2,083 posts)As with so many legal and political issues, many interpretations are possible. And if the final interpretation is up to the SC, then this'll be a tough row to hoe.

(12,449 posts)and I do agree, it would be up to the SC and I highly doubt they would go against their own interests.
Great talking to you, have a peaceful Sunday.

(8,845 posts)dare not cross the party, or their "Golden Parachute" will go away upon retirement. If they don't carry the parties water the entire time they are in office, they don't get one of those cushy lifetime appointments from some Republican Corporation or Academic Institution.
It's a revolving door for all of them........

(14,592 posts)Nor is the Electoral College.
Nor is the fact that Wyoming, North Dakota, and South Dakota each have two US Senators - a Senator in Wyoming represents only about 500,000 people, while a Senator in California represents around 20 million, and one in Colorado represents about 2.7 million.
That is an imbalance we need to rectify.

(10,921 posts)All the GOP tricks must be banned:
Photo id's
Purging
Border "adjustments"
Mail-in limits
Vote box limits
Quite realistically, there are so many different tricks being used across the country, that the best thing to do is a comprehensive federal bill.
