If you believe a 6-3 conservative Court is going to run roughshod over the States and the Constitution, explain why a 5-4 onsetvative Court didnt feel the moose red to di the same thing before yesterday.

(1,665 posts)Roberts hadn't signed his name in blood to the Trump cause like Kav, Gorsuch, Thomas, Barrett, and Alito. Now, Roberts can defect and he can't stop the other 5 from moosing red to di.
Roberts SEEMED to care about something beyond partisan ideology. Whether it was his legacy, actual human compassion, actual patriotism, or whatever, it separated him from the actual ideologues on the court. It was 5-4 conservative, but only 4 were ideologues. Now it's 5-4 in favor of ideologues who don't give an f about anything beyond moosing red to di, who'll sell out their mothers--not to mention their country--just for a chance to moose even the tiniest red to di, and that's the difference.

I personally think that McConnell made several strategic blunders here:
1. He motivated Democrats and socially moderate independents (and even Republicans, what few remain) to come out in numbers we've probably not seen in years.
2. He took the single argument for evangelicals voting for Trump off the table a week before the election. They have someone who will overturn Roe v Wade on the bench, and that means those same evangelicals will now look at the character of Trump instead of seeing him simply as a means to an end, which won't end well for him.
3. He's assured that a Democratic Senate will defang the filibuster, making it a lot harder for the GOP to gain much leverage.
4. He's turned two generations of young women away from the GOP permanently.
5. Roberts does not want another Bush vs. Gore. If it comes down to that, he will simply refuse to take the case - and I do not believe he will let Kavenaugh's shoddy reasoning stand as jurisprudence.

(6,385 posts)Roberts doesnt decide what cases SCOTUS take up. It take 4 justices to grant cert...morning take the case. And Roberts is still just one vote.
To me the single biggest issue is that on todays court, the fifth justice, the so called swing vote because she or he is the ideological center of the court...the fifth justice is Alito. The common sense of the court test with him.
Think about that for insanity.

(1,604 posts)I think what's happening with the supreme court is horrible, but I'm not so sure that the fifth justice IS Alito. I'm more inclined to believe it's Kavenaugh. He's conservative, but he's also been taken under the wing of Roberts, and while his judgments are not great, I don't think he's going to end up being as conservative as either Alito or Thomas.
As to your point, yes, you need four justices for certiorari, but Roberts has a lot of influence there.

(6,385 posts)I guess the idea of Alito being the center is based on an assessment of each judges decisions. As we get weaker resumes like Kav and Barrett thats going to be more of a crapshoot.
I can see the under Roberts wing thing with Kav. He just seems, from a distance, to be one of those prep school suck ups to the boss that used to drive me crazy at the office.
Maybe its like the Sith in Star Wars...there must always be two, but only two. Now its Roberts n Kav.

(53,840 posts)echo chamber and side with the four justices whose collective judgments are not always clouded by racism, sexism and all the other "isms" usually wallowed in by the four extreme right winger justices.
Ocassionaly that would happen, now even if it does it won't matter because the wingers will still revel in their extreme wallowings.
