If the House and Senate don’t vote to make it permanent within 3 weeks then he would be restored to power. But we only need two weeks. Which means this could be handled without any vote from Congress.

Conviction requires a 2/3 vote by the Senate. That is unlikely to happen and in any event would take some time to happen.

The 25th amendment can remove Trump from power immediately without any vote by Congress.

Technically it takes a 2/3 vote by both the House and Senate to make it permanent. However he can be removed from power for up to 21 days in the meantime. Which is long enough to run out the clock.

I'm not hoping to be right about this, but I'm just saying that I think it would be a tough vote.

Either way, Trump is much more disgraced as a figure in history after today. Lots of people supported Sen. Joseph McCarthy in his time, but things reached a point where he was universally accepted as a negative figure. I think that today helps cement Trump moving into that category.

Here are the steps:

1) The VP and cabinet declare the President unfit. The president is immediately removed from power.

2) If the President responds to Congress that his is fit for office, he is immediately restored to power unless the VP and cabinet declare in writing that he is unfit within 4 days.

3) Congress has 21 days to vote on it.


It seems somewhat odd because it requires the VP and cabinet to declare him unfit twice. But I believe this is designed to allow the VP and cabinet to quickly remove him with a simple statement then give him a chance to respond and give the VP and cabinet a chance to make a more detailed argument to be decided by Congress.

Also it makes it possible to happen instantly and permanently if the President doesn’t respond. Like if he was being removed because he was in a coma or some other debilitating condition.

I gotta say I am humbled... 719 recs and counting!

It ain't about me though... I just tapped into the DU zeitgeist I guess lol. If I didn't post this myself, I would've (and have actually) supported others' threads about invoking the 25th.

Now it's up to the politicians... up to Pence and company.... stop talking about it and just do it.

Losing hope but clinging to it at the same time.

Benedict Donald can do a lot more damage in 13 days.

He can't post on Facebook but he's still got the nuclear codes?

The process is set forth in Section 4 of the 25th Amendment:

Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.

Thereafter, when the President transmits to the President pro tempore of the Senate and the Speaker of the House of Representatives his written declaration that no inability exists, he shall resume the powers and duties of his office unless the Vice President and a majority of either the principal officers of the executive department or of such other body as Congress may by law provide, transmit within four days to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office. Thereupon Congress shall decide the issue, assembling within forty-eight hours for that purpose if not in session. If the Congress, within twenty-one days after receipt of the latter written declaration, or, if Congress is not in session, within twenty-one days after Congress is required to assemble, determines by two-thirds vote of both Houses that the President is unable to discharge the powers and duties of his office, the Vice President shall continue to discharge the same as Acting President; otherwise, the President shall resume the powers and duties of his office.

As much as he should be removed, the reality is he will be out of office before the process can be completed. The only way he leaves early is if he gets a quid pro quo from Pence, i.e., pardons for Trump and his family. I’d rather he stay if that is the price. I want him locked up.

Honestly, I don't think I'm being melodramatic. I don't think he would just snap in a given moment and launch an instant later, but I'm not sure the runup would come with a lot of warning, either. I don't think of this as a likely scenario, but I am sure not thrilled with living with the possibility for another 2 weeks.

a threat to the Constitution of the United States of America.He’s every bit as incapacitated in his own way as Woodrow Wilson was in his last few months in office. He should be removed.
